The Osun State House of Assembly has challenged the All Progressives Congress, APC, to approach the court if it believes the Osun State Integrated Transport, Traffic and Park Management System Bill, 2026 is unconstitutional.
osun.life reports that the APC had earlier, through its spokesperson, Kola Olabisi, described the bill as “legislative harakiri”, unenforceable and a recipe for crisis, demanding its withdrawal on grounds that regulation of motor parks belongs exclusively to local governments under Section 7(1) and the Fourth Schedule of the 1999 Constitution.
However, the Chief Press Secretary to the Speaker, Olamide Tiamiyu, in another statement, said the APC’s position was flawed and based on a selective reading of the Constitution without appreciating the constitutional relationship between the state and local government councils.
The Assembly explained that Section 7(1) not only guarantees democratically elected local governments but also mandates state governments to ensure their existence under a law providing for their establishment, structure, composition, finance and functions.
The statement further argued that the Constitution deliberately places the legislative framework for local governments within the state legal architecture, and it is therefore erroneous to suggest that a matter listed under local government functions automatically removes it from the competence of the state legislature.
The Assembly maintained it followed due legislative process under Section 100 of the Constitution and described it as curious that the APC would declare the law “dead on arrival” instead of allowing constitutional processes to take their course.
“If the APC genuinely believes that the law is unconstitutional, the courts are open to it. If the APC considers its interpretation of the Constitution so compelling, it should test that interpretation before the court of law rather than attempt to determine constitutional validity through press statements,” it said.
