The All Progressives Congress, APC, has rejected the Osun State Integrated Transport, Traffic and Park Management System Bill recently passed by the State House of Assembly, describing it as unconstitutional.
The State Assembly had passed the bill on Wednesday after considering the committee report and completing its third reading.
The bill seeks to create an integrated framework for the registration, regulation, management and digital administration of commercial transport, traffic, motor parks, terminals, garages and loading points, with a major provision for a digitalised ticketing system to eliminate multiple ticketing and improve transparency in transport revenue collection.
But the APC, in a statement on Thursday by its Director of Media and Information, Kola Olabisi, faulted the legislation and demanded its immediate withdrawal.
The opposition party argued that the state lacks the constitutional authority to directly regulate and manage motor parks, noting that such powers belong to local government councils.
“Your Bill on Integrated Transport, Traffic and Park Management is a legislative harakiri, unenforceable and a recipe for crisis. We urge the lawmakers to withdraw the legislation,” the party said.
Citing Section 7(1) of the 1999 Constitution and the Fourth Schedule, the APC said the establishment, maintenance and regulation of motor parks are functions assigned to local governments.
According to the party, the proposed law could conflict with the Constitution if it seeks to transfer direct control and revenue collection of motor parks to the state government.
The party urged the Assembly to focus on productive and legal laws that would support governance without creating avoidable conflict, insisting that where a state law conflicts with the Constitution, constitutional provisions take precedence.
