A Chief Magistrate Court sitting in Osogbo has ordered the prosecution of a police officer attached to the Cyber Crime Unit of the State Criminal Investigation Department, Osun Command, CPL Bankole Olumide, for perjury.
Magistrate A. A. Adeyeba, who gave the order, accused the Nigeria Police and Olumide of misleading the court to obtain a remand order.
The Certified True Copy of the order stated that the police had, on September 3, filed an application to remand three persons – Adeniyi Ahmed (25), Sikiru Oyebode (24) and Oguniyi Tunmise (23) – arrested for malicious damage, with Olumide deposing to an affidavit, which the court granted for 14 days.
However, upon expiration of the 14-day order, the police, instead of releasing the suspects on bail or charging them to court, filed a fresh ex parte application on September 22, adding a fourth suspect, Lukman Ayuba (37), with Olumide again deposing to an affidavit.
Magistrate Adeyeba described the development as an abuse of court process, noting that the new application was a duplication of the earlier one filed on September 3, 2026, with Suit No. MOS/845/2026.
The CTC partly read, “It is very unfortunate that Nigeria Police could be misleading the court to get an Order, especially the deponent to the Affidavit in support, one CPL Bankole Olumide. The present application is a duplication of the one filed on the 3rd September, 2026.”
It further read, “Instead of the police to charge the Respondents in MOS/M.845/2026 to court or release them on bail, they resulted in duplicating facts, application and Affidavit. This is highly shameful, ridiculous and embarrassing. I will not allow anybody to use this Honourable Court to do injustice to any citizen of Osun State.”
The magistrate consequently refused the fresh application and warned the Osun Police Command against misleading any court in the state.
He ordered the immediate release of the 1st to 3rd respondents or charge them to court unfailingly, and ordered that the 4th respondent be released on bail or charged to court unfailingly on Friday, September 25, 2026, while ordering that “The Deponent to the Affidavit in Support, CPL Bankole Olumide, is ordered by this Honourable Court to be charged with perjury.”
