Omisore withdraws case against APC, INEC

A former deputy governor of Osun State, Senator Iyiola Omisore, has withdrawn a case he filed against the All Progressives Congress and the Independent National Electoral Commission over the primary election of the party in Osun.

It would be recalled that Omisore had in the suit filed before the Federal High Court sitting in Osogbo, asked the court to determine whether the APC which is the 1st defendant has the power to impose nomination qualification, or disqualification criteria,
measures, or conditions on any aspirant for its primary election in its
constitution, guidelines, or rules for the nomination of candidates.

The former national secretary of the APC also urged the court to determine whether the decision of the party to set guidelines and rules for
aspirants/candidates for the Osun State Governorship primary election and the
subsequent disqualification of the Plaintiff as a governorship aspirant is not in
contravention of Section 84 (2) & (3) of the Electoral Act 2022 (as amended)
as well as Sections 177 and 182 of the 1999 Constitution of the Federal
Republic of Nigeria (as amended).

But in the notice of discontinuance filed before court and dated March 11, a copy obtained by osun.life, Omisore said the issue in the suit has been reconciled.

“TAKE NOTICE that upon the reconciliation of the issues in this suit, the Plaintiff hereby withdraw and/or discontinues in its entirety his Claim in the suit herein against
the Defendants,” the notice read.
