Court remands two for felony, rape

A Magistrate court sitting in Osogbo has remanded John Osein, 19 and Gbenga Ayelangbe, 25 in Ilesha prison for felony and allegedly having carnal knowledge of a girl (name withheld).

The prosecutor Asp Fagboyinbo Abiodun told the court that the accused persons on the 16 of June, 2019 at about 10pm at Eepon compound number 25 Kolawole Area of Osogbo conspired and committed felony and assaulted a girl.

He stated that the accused persons unlawfully, and by means of threats and intimidation had carnal knowledge of a girl, stole one Itel phone valued at the sum of N3,500 and a purse containing a cash sum of N34,400, the property of the same victim thereby committing an offence contrary to and punishable under sections 516 A (1), 335, 353, 357, 390(4) (B) of criminal code Cap 34 Vol 2 Law of osun state Nigeria 2002 and 2003.

The accused persons who is facing a five count charge pleaded not guilty for the charges against them.

Osein pleaded that he committed the offense under the influence of alchohol, while Gbenga told the court that he was in his right senses but it was devil’s handwork.

Magistrate M. A Awodele after listening to the accused persons plea remanded them in Ilesha prison.

The case was however adjourned till 30th July, 2019 for ruling on bail.
