Court adjourns APC tenure elongation suit to November 27

The Federal High Court sitting in Osogbo, Osun State Capital, has adjourned the suit instituted by the reinstated Chairmen and Councilors of the All Progressives Congress, seeking legal determination of their tenure to November 27 for hearing.

The APC chairmen had instituted the case, seeking legal determination of their tenure and challenging the validity of Local Government Elections conducted in February 2025 by the incumbent Governor Ademola Adeleke in the state.

In the suit No. FHC/OS/CS/147/2025 between Onibonokuta Saheed & 7 Ors v AGF & 6 Ors, the Claimants seek among other reliefs whether they are entitled to 3 years in office commencing from February, 2025 and whether the OSSIEC could validly on 22nd February, 2025 conduct elections into the same offices during the subsistence of their tenure of office.

At the hearing on Monday, Barrister Muhydeen Adeoye Esq., Counsel for the Claimants introduced a motion for restraining the Defendants from disturbing his clients in office while the substantive suit pends.

However, Counsel for the 3rd & 4th Defendants, Barrister F.K. Labo-Popoola, Counsel for the 5th Defendant, Barrister Rachael Ojomi, and Counsel for the 6th Defendant, Barrister J.A. Ayanyemi argued that they were still within the time to react to the main summons.

Meanwhile, the presiding judge, Justice Adefunmilola Demi-Ajayi, noted from the court record that service is not yet complete and that the counsel should ensure that the process is served on all the parties before the next date of adjournment.

Justice Demi-Ajayi adjourned the matter to November 27, 2025, for hearing.
