JUST IN: Court restrains UBA from paying Osun LG funds to APC Chairmen

By Tunde Olamilekan

An Oyo State High Court has restrained the United Bank of Africa from disbursing the withheld local government allocations to council officials elected under the All Progressives Congress in Osun State.

It would be recalled that the All Progressives Congress in Osun State on Sunday confirmed that the withheld allocations have been paid by the federal government to the APC chairmen.

But the state government in a motion dated September 26, urged the court to restrain the bank from disbursing the funds to the APC council officials.

The Osun State Attorney General and the Osun State Local Government Service Commission had sought a motion of an “Order of Interim Injunction restraining the Defendant/Respondent from paying and/or causing to be paid all and/or any of that funds which constitute the statutory Local Government funds of all the 30 Local Governments in Osun State.”

The state government, in the motion ex parte, also urged the court to mandate UBA not to release the said funds mentioned pending the hearing and determination of the Motion on Notice for an order of interlocutory injunction.

In his ruling, Justice A.L. Akintola granted the injunction stopping the bank from disbursing the fund to the APC chairmen.

The court noted that “it is only an interim order that the defendant/respondent will have the opportunity to possibly challenge once the defendant turns up to join issues with the claimants on the motion on notice for an order of interlocutory injunction already filed in this case.”
