An Osun State High Court sitting in Oshogbo has adjourned the ruling in the case of Senator Ademola Adeleke certificate forgery till Wednesday, 8th of August 2018.
The presiding Judge, Justice David Oladimeji adjourned the ruling till Wednesday to decide the eligibility of Senator Adeleke’s for the September 22nd Osun Governorship election.
Recall that Justice Oladimeji had earlier adjourned the hearing to Monday 6th of August for all parties to be properly served and for all application including interlocutory to be heard.
The counsel to the plaintiffs, Barrister Olufemi Ayandokun argued that the court should note the discrepancy on dates written on the exhibits, claiming Osun state has not been created as at the date they issued the certificate in 1988. Hence the certificate was forged.
Barrister Olufemi Ayandokun urged the court to dismiss the notice of preliminary objection for lacking in merit and uphold the summon of interlocutory injunction and grant all relief in the originating summons and strike out all the counter affidavits.
Edmund Boriomoni who is the first defendant counsel told the court to dismiss the suit for lacking merit and jurisdiction, that the matter is supposed to heard at the Federal High Court.
However, he said there are 48 paragraphs of affidavit on 22 grounds and three exhibits in support of the affidavits.
Edmund argued that the plaintiff counsel already admitted that his client indeed possess the school leaving certificate, which made him to qualify to run irrespective of the grades of the result and that discrepancy in date written on the exhibits is not his client’s fault.
Lastly, the Presiding judge, Justice David Oladimeji, adjourned the final ruling till Wednesday, August 8th, to be able to meet up with the deadline date for substitution of candidates at the INEC office.
