An Osun State High Court sitting in Osogbo, has again adjourned ruling on a case filed by two Peoples Democratic Party (PDP) members over the eligibility of the Party’s flagbearer, Senator Ademola Adeleke.
Rasheed Olabayo and Olasunkanmi had approached the court, claiming that Senator Adeleke did not possess school leaving certificate as required by section 177(d) of the 1999 constitution and told the court to set aside the July 21st PDP primary elections that produced him as the party’s candidate.
Recall that the presiding Judge, Justice David Oladimeji had earlier refused an interlocutory injunction filed by the applicant to restrain the party from forwarding the name of Senator Ademola Adeleke to the Independent National Electoral Commission (INEC).
However, in a seeming twist, the lead counsel to the plaintiff, Barrister Femi Ayandokun, informed the court since its an intra party affair, the leaders of the party have discussed about the matter and they have suggested an out of court settlement.
Meanwhile, the presiding Judge, Justice David Oladimeji in his wisdom adjourned the ruling to Monday, August 6th for the fourth defendant INEC to be served and all application including the motion on notice of interlocutory to be heard.
