The plaintiff, Oba Kadiri Adeoye in the application filed by his counsel, Mr. Soji Oyetayo against the Iwo monarch, Oba Akanbi Adewale in magistrate court Osogbo has been withdrawn by the monarch’s counsel.
During the sitting of Magistrate court Osogbo, Osun State presided on by Olushola Aluko on Friday. The Applicant’s counsel Mr. Soji Oyetayo told the court that ” We have filed a letter of withdrawal pertaining to the application which has been submitted to court and will be very grateful it the court could effect the discontinual of the case”
The Magistrate, Mr. Olushola Aluko in response to the prayer of applicant counsel said “I have seen the letter of withdrawal; I won’t entertain it, I don’t want to know the people behind your withdrawal I have said in the previous ruling that the application is stepped down until the issue of contempt is dealt with”.
Soji Oyetayo further his explanation to the Magistrate said “several eminent personality both within and outside the state showed interest in the case including the south west leaders. In view of this we want to withdraw the application and some of those who intervene are in court who have something to say in order to ensure that peace rules in Osun-State”.
Magistrate said they can’t address the court but he will allow them as royal fathers who deserve honor because anybody who want to address the court can be eligible on bases of some criteria.
The twelve monarchs in court from the Iwo council led by the Chairman of Iwo Traditional Council, Oba Ahmed Adekunle, Olowu of Kuta addressing the magistrate said “We are not here in solidarity to disrespect you and Oluwo, Oba Akanbi Adewale will never do that”
“Regrettably, we want to tell the court and yourself that we are very sorry and no monarch will disrespect you and we promise to hold the judiciary in high esteem; all what you saw and read on social media are misquoted out of contest. We urge you to tamper justice with mercy on the other leg of the case”
” He had once used his personal fund to rehabilitate the court, he hold the judiciary paramount in time past”
“The bench warrant you issued God has granted it that is why he’s (Iwo Monarch) not in court this morning because he is indisposed”
The counsel to the defendant, Mr Laide Yekini also said ” The case is a wound which we want to be close up, personally I urge the court to grant the application of discontinuance”.
The Magistrate, Mr. Olushola Aluko forwarded the case to the registry for reassignment and adjourn the case till 15th February, 2017.
However, the plaintiff, Oba Kadiri Adeoye in an interview after the court sitting explained ” Governor Rauf Aregbesola and former President, Chief Olusegun Obasanjo played a vital role in the resolution of the dispute, some other prominent personalities from diaspora and within the country which is the reason of my withdrawal”.
